BNSF is in a good position to Implement STB Decision on Fuel Surcharges

FORT WORTH, Texas, January 29, 2007:

BNSF is in a good position to take steps to implement the STB's findings on fuel surcharges issued Friday.  In previous statements to the STB, BNSF supported mileage based fuel surcharges and has already implemented them in two of our four business units, Coal and Ag Products.

BNSF will work with our interline partners on joint rates to extend mileage surcharges on those movements as well.   BNSF has already taken appropriate actions with respect to "double dipping" of fuel surcharges by reducing the fuel component in the annual escalator.

On freight not within the scope of the decision, BNSF will continue to assess our current and alternative methodologies for customers not covered by the ruling.

Last week BNSF released 4Q and full year earnings, and those results show that the company has not collected fuel surcharges in excess of unhedged fuel cost over threshold price for the year.
